Acceptable Use Policy

1. Scope

  1. This Acceptable Use Policy (AUP) applies to the use of the Scram Software Platform (the Platform). We may update this AUP from time to time.

2. Acceptable Use Standards

  1. You may use our Platform only for lawful purposes. You may not use our Platform:
    1. In any way that is unlawful under any applicable law, or is fraudulent, or has any unlawful or fraudulent purpose or effect.
    2. For the purpose of harming or attempting to harm minors in any way.
    3. To attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Software in any form or media or by any means, or attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human- perceivable form all or any part of the Platform (including its object code and source code).
    4. To develop, train or improve any artificial intelligence or machine learning models except as may be permitted by Scram.
    5. Except as permitted through any supported application programming interfaces / APIs, use any automated or programmatic method to extract data or an output, including scraping, web harvesting, or web data extraction.
    6. To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
    7. To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
    8. In contravention of the provisions of our Scram Terms.
    9. To gain unauthorised access to or use of computers, data, systems, accounts or networks.
    10. To do anything that infringes, misappropriates or violates our or any third party’s intellectual property rights or other rights (such as privacy, publicity and other proprietary rights).
    11. In contravention of the Content Standards listed below.

3. Content Standards

  1. These content standards apply to any and all (i) material which you (or your authorised users) upload to the Platform or (ii) any output, apps or works that you (or your authorised users) generate or create through the Platform (Content), and to any interactive services associated with it.
  2. Content must comply with the law applicable in England and Wales and in any country from which it is posted or created.
  3. Content must not:
    1. Be defamatory of any person.
    2. Be obscene, offensive, hateful or inflammatory.
    3. Promote sexually explicit material.
    4. Promote violence.
    5. Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
    6. Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
    7. Promote any illegal activity.
    8. Be in contempt of court.
    9. Be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
    10. Be likely to harass, upset, embarrass, alarm or annoy any other person.
    11. Impersonate any person, or misrepresent your identity or affiliation with any person.
    12. Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
    13. Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

4. Breach of this AUP: Suspension or Termination of the Platform

  1. In order to identify any breaches of the above we will monitor your use of the Platform.
  2. Failure to comply with this AUP may result in Scram taking all or any of the following actions (without affecting any other rights or remedies available to Scram):
    1. Issue of a warning to you;
    2. Immediate, temporary or permanent removal of any Content uploaded by you to the Platform;
    3. Immediate, temporary or permanent withdrawal of your right to use the Platform.
  3. If Scram suspects you are in breach of this AUP it will notify you and ask you to rectify the breach within 5 days of such notification. If you still remain in breach after this period, Scram may suspend or terminate your access to the Platform in its own discretion.
